TERMS OF SERVICE

Welcome to MyPaidPost (accessible via https://mypaidpost.co.ke and https://mypaidpost.com). These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "Creator," or "Subscriber") and MyPaidPost ("we," "our," or "us"). By creating an account, accessing our platform, or engaging with any of our paid or unpaid services, you acknowledge that you have read, understood, and agreed to be bound by these Terms.
If you do not agree to these Terms, you must immediately cease use of the platform.
1. DESCRIPTION OF SERVICES
MyPaidPost is a social media subscription and content monetization platform designed to empower creators. Our primary services include:
- Creator Profiles: Personalized pages where Creators can showcase their brand, bio, and monetized content.
- Subscription-based Content: Premium content locked behind a recurring subscription payment.
- Co-Hosting and Collaboration: A feature that allows multiple Creators to share revenue and collaborate on a single post or event.
- Referral Marketing: A system where Creators can earn passive commissions by referring new users to the platform.
- Payout Management: Secure revenue accumulation and withdrawal systems designed to help Creators receive their earnings reliably.
2. ELIGIBILITY AND ACCOUNT REGISTRATION
- You must be at least eighteen (18) years of age to register as a Creator or Subscriber on MyPaidPost.
- You agree to provide accurate, current, and complete information during the registration process and to maintain the security of your password and account credentials.
- You are solely responsible for all activities that occur under your account, whether conducted by you or any authorized third party.
- We may require you to verify your identity, bank account, or mobile money wallet before activating payout services. We reserve the right to conduct anti-money laundering (AML) and know-your-customer (KYC) checks in line with local financial regulations.
3. CREATOR CONTENT AND INTELLECTUAL PROPERTY RIGHTS
Intellectual property is the cornerstone of a healthy creator economy. By uploading content to MyPaidPost:
- Ownership: You retain 100% ownership of all content you upload, including photos, videos, audio, text, and graphics.
- License Grant to Platform: You grant MyPaidPost a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to host, store, display, reproduce, modify, and distribute your content for the purpose of operating, promoting, and improving the platform.
- License to Subscribers: You authorize MyPaidPost to make your content available to paying Subscribers for their personal, non-commercial viewing and use, subject to the platform's security and digital rights management (DRM) protections.
- Warranties: You represent and warrant that your content does not infringe on the intellectual property rights, privacy rights, or other legal rights of any third party.
4. ACCEPTABLE USE AND PROHIBITED CONTENT
To maintain a safe and legally compliant ecosystem, the following activities and content are strictly prohibited:
- Attempting to bypass, crack, reverse-engineer, or circumvent the platform's DRM, paywalls, or access-control mechanisms.
- Creating multiple accounts to exploit referral bonuses, subscription trials, or promotional credits (click fraud).
- Uploading child sexual abuse material (CSAM), explicit non-consensual content, or content involving non-consenting adults.
- Engaging in harassment, hate speech, cyberbullying, or defamation of other Users or Creators.
- Conducting fraud, phishing, or identity theft, or misrepresenting your identity for financial gain.
- Distributing malicious software, viruses, or any code intended to damage or interfere with platform operations.
- Engaging in illegal activities that violate the laws of the Republic of Kenya or any other applicable jurisdiction.
5. FINANCIAL TERMS: FEES, BILLING, AND PAYOUTS
A. SUBSCRIBER BILLING
- Subscription fees are charged in advance on a recurring basis (daily, weekly, or monthly) as configured by the Creator.
- Subscribers authorize MyPaidPost to charge their chosen payment method (Mobile Money, credit card, or debit card) automatically until they cancel their subscription.
B. PLATFORM FEES AND REVENUE SHARE
- MyPaidPost charges a platform commission on each successful subscription transaction to cover payment processing, hosting, DRM enforcement, and customer support infrastructure.
- The exact fee structure may be updated from time to time, and any material changes will be communicated to Creators at least fourteen (14) days in advance.
C. CREATOR PAYOUTS
- Creators can withdraw their accumulated earnings via M-Pesa, bank transfer, or other available payout methods.
- Payouts are subject to verification, identity checks, and anti-fraud review before release.
- Minimum payout thresholds and processing timelines are published in the Creator Dashboard and may be updated to reflect operational realities.
D. REFUND POLICY
- All subscription payments are non-refundable once the Subscriber has accessed the premium content, as digital goods cannot be "returned."
- Refunds will only be issued in cases of demonstrated platform malfunction, duplicate charges, or where required by applicable consumer protection laws.
6. CO-HOSTING AND COLLABORATION POST TERMS
The Co-Hosting feature enables a primary Creator ("Host") to invite a secondary Creator ("Co-Host") to collaborate on a post and share in its revenue. The following terms govern all collaboration posts:
- Host Fee: The Host is charged a one-time hosting fee per collaboration, with a minimum fee of Kes. 100/- (one hundred Kenyan Shillings).
- Escrow Approval: A Host must approve the Co-Host's participation within a 24-hour window after the Co-Host accepts the invitation. Failure to approve within this window will result in automatic cancellation of the collaboration.
- Revenue Distribution: The revenue generated by the collaboration post is distributed as follows: sixty-five percent (65%) to the Host, fifteen percent (15%) to the Host's original Platform Referrer, and twenty percent (20%) to MyPaidPost.
- Content Ownership: Each Co-Host retains ownership of the specific content segments they contribute to the collaboration post.
7. TERM AND TERMINATION
- You may terminate your account at any time by contacting support or using the account deletion tools in your settings.
- We reserve the right to suspend or terminate accounts, with or without notice, for breach of these Terms, illegal activity, or conduct that threatens the integrity and safety of the platform.
- Upon termination, your access to premium content ceases, but earned revenue that has been validly accrued and processed will be paid out according to our standard payout cycles.
8. LIMITATION OF LIABILITY AND DISCLAIMERS
- The platform is provided on an "AS IS" and "AS AVAILABLE" basis. We do not warrant that the platform will be uninterrupted, error-free, or completely free of security vulnerabilities.
- To the maximum extent permitted by law, MyPaidPost shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of the platform.
- MyPaidPost acts as a hosting and transaction facilitation intermediary only. Creators are independent contractors and not employees or agents of MyPaidPost.
9. GOVERNING LAW
These Terms shall be governed by and construed in accordance with the laws of the Republic of Kenya. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Kenya.
10. CHANGES TO THESE TERMS
We may update these Terms from time to time to reflect new features, legal requirements, or operational changes. We will notify you of material changes at least fourteen (14) days before they take effect. Continued use of the platform after the effective date constitutes acceptance of the revised Terms.
